Ted Leroy Trucking fined $75,000 for Robson Bight pollution incident

CAMPBELL RIVER, B.C. -- July 5, 2012 -- Ted Leroy Trucking Ltd. of Chemainus, British Columbia, was convicted in the Campbell River Provincial Court of six charges laid under the Fisheries Act, the Migratory Birds Convention Act, 1994, and the Canada Shipping Act, 2001, in relation to an incident on August 20, 2007.

The convictions result from the partial capsizing of a barge that released petroleum products into Johnstone Strait during a commercial marine towing operation. The petroleum products were released in waters frequented by fish and by migratory birds.  Within hours of the spill, an Environment Canada enforcement officer was on site conducting an investigation.

As the federal authority responsible for enforcing the Canada Shipping Act, 2001, Transport Canada led the joint investigation. Environment Canada was the federal authority responsible for enforcing the Migratory Birds Convention Act, 1994, and the pollution prevention provisions of the Fisheries Act.

The Provincial Court of British Columbia sentenced Ted Leroy Trucking Ltd. to pay a total of $75,000. The penalty represents a $5,000 fine and an obligation to pay $70,000 for work and expenditures promoting proper management, control, conservation and/or protection of fish or fish habitat, including the Johnstone Strait area.
