N.W. Cole Associate Appraisers Limited to Pay $10,000 Penalty for Violating Federal Environmental Law

HALIFAX, N.S. -- January 31, 2011 -- N.W. Cole Associate Appraisers Limited pleaded guilty to charges of violating the Export and Import of Hazardous Waste and Hazardous Recyclable Material Regulations under the Canadian Environmental Protection Act, 1999 during a court appearance on January 27, 2011 in Halifax, Nova Scotia. The company was ordered to pay a $10,000 penalty under the Canadian Environmental Protection Act, 1999.

On August 12, 2009, Environment Canada launched an investigation into the illegal export of electronic waste products to Hong Kong by N.W. Cole Associate Appraisers Limited, a Halifax based company. The investigation stemmed from an inspection by Environment Canada on July 23, 2009, of a sea container at the Port of Halifax’s Halterm Terminal which contained assorted old computer and electronic parts.

On January 14, 2010, Environment Canada laid a charge against N.W. Cole Associate Appraisers Limited for exporting electronic waste to Hong Kong -- a violation of the Export and Import of Hazardous Waste and Hazardous Recyclable Material Regulations under the Canadian Environmental Protection Act, 1999.

The Court ordered that $9,500 of the penalty will be directed to the Environmental Damages Fund for use in Nova Scotia. A fine of $500 will be paid to the Court.
